Acceptance of Terms
By accessing or using PLC Assist, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.
Use of Services
Account Registration
To access certain features of PLC Assist, you may be required to create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Promptly update any changes to your information
- Accept responsibility for all activities under your account
Acceptable Use
You agree not to:
- Use PLC Assist for any unlawful purpose
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Transmit any harmful, threatening, or offensive content
- Attempt to gain unauthorized access to our systems
- Interfere with the proper functioning of our services
- Use automated systems to access our services without permission
AI-Assisted Code Generation
PLC Assist includes AI-powered features that assist with PLC programming, code generation, and code modification for use with CODESYS and similar industrial automation platforms.
No Guarantee of Correctness
AI-generated code, suggestions, and modifications are provided on an "as-is" basis without any guarantee of correctness, completeness, safety, or fitness for any particular purpose. You acknowledge that:
- AI-generated code may contain errors, bugs, or logical flaws
- AI suggestions may not comply with applicable safety standards or industry regulations
- AI outputs may not be suitable for safety-critical applications without thorough review
- The AI may misinterpret your intent or produce unexpected results
Your Responsibility
You are solely responsible for reviewing, testing, validating, and verifying all code before deploying it to any PLC, controller, or industrial system. This includes but is not limited to:
- Reviewing all AI-generated or AI-modified code for correctness
- Testing code in a safe, controlled environment before deployment
- Ensuring compliance with all applicable safety standards (e.g., IEC 61131-3, IEC 62443, ISO 13849)
- Performing proper risk assessments before deploying code to production systems
- Maintaining proper safety measures, emergency stops, and fail-safes independent of software
Industrial Automation Disclaimer
PLC Assist is a development tool. We do not control, monitor, or take responsibility for the physical systems, machinery, processes, or environments where code developed using our platform is deployed. Deploying untested or unverified code to industrial control systems can result in equipment damage, production loss, environmental harm, or serious personal injury.
Local Bridge Connection
PLC Assist connects to CODESYS running on your local machine through a local bridge script. Your PLC project code is processed locally on your machine. We do not have access to your PLC project files or the code running on your controllers unless you explicitly share it through our AI features.
Intellectual Property
Our Content
All content, features, and functionality of PLC Assist are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
Your Content
You retain full ownership of all PLC code, project files, and other content you create using PLC Assist. By using our AI features, you grant us a limited license to process your code solely for the purpose of providing AI assistance during your active session.
Payment Terms
Fees
Some features of PLC Assist require a paid subscription. You agree to pay all applicable fees as described on our website. All fees are non-refundable unless otherwise stated.
Billing
We may bill you through an online account or other methods. You authorize us to charge your chosen payment method for all applicable fees.
Termination
We may terminate or suspend your access to PLC Assist immediately, without prior notice, for any reason, including if you breach these Terms of Service.
Upon termination:
- Your right to use our services will immediately cease
- We may delete your account and any associated data
- Provisions that should survive termination will remain in effect
Disclaimers
PLC Assist is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- Our services will be uninterrupted or error-free
- Defects will be corrected
- Our services are free of viruses or harmful components
- Any code generated, suggested, or modified by our AI features will be correct, safe, or suitable for any purpose
- Our services comply with any specific industrial safety standard or regulation
Limitation of Liability
To the maximum extent permitted by law, PLC Assist and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:
- The use or inability to use our services
- Any code generated, suggested, or modified by our AI features
- Any errors, inaccuracies, or omissions in AI-generated code
- Any damage to equipment, systems, or property resulting from code developed using our platform
- Any personal injury or death resulting from code developed using our platform
- Loss of profits, revenue, data, or goodwill
- Business interruption or production downtime
- Any unauthorized access to or alteration of your data
This limitation applies regardless of whether the damages are based on warranty, contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
Indemnification
You agree to indemnify and hold PLC Assist and its operators harmless from any claims, damages, losses, and expenses arising out of:
- Your use of our services
- Your deployment of code to any system or environment
- Your violation of these Terms of Service
- Your violation of any applicable safety standards or regulations
- Your violation of any rights of another party
Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify you of any material changes by posting the new terms on our website. Your continued use of PLC Assist after such changes constitutes acceptance of the new terms.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.
